What is foreclosure?

A property owner that has a mortgage is required by the terms of the loan to make payments. When the owner fails to make those payments, he is in default. The lender starts sending letters to the mortgage to try to collect the mortgage payments and late fees. If that does not work, after a few months the lender starts foreclosure proceedings to take possession of the title of the foreclosure property from the owner.

Foreclosures in the United States are not standardized. Each federal and local government has different laws and procedures regarding foreclosures.

What are the sources of foreclosure properties?

• Bank foreclosures - the majority of the foreclosed homes come from loans made by banks.
• Other lending institutions - credit unions, mortgage companies, etc.
• HUD homes - FHA (Federal Housing Administration), which is part of HUD (Housing and Urban Development), guarantees payment on certain loans, and when homeowners default on those FHA insured loans, the property is foreclosed. FHA then transfers the title to HUD. The HUD homes are then listed for sale at auctions.
• VA homes - There are some homes owned by VA (Veterans Affairs) because veterans defaulted on loans that were guaranteed by VA. The VA houses are sold in auctions to anyone; you do not have to be a veteran to buy a VA home.
• Government agencies - Other government agencies also own properties that they have repossessed due to non-payment on loans, taxes, etc., or they are properties seized in criminal cases.
